Request copies of the assignee’s periodic accountings. Ask for updates on asset sales and their prices. Attend any creditors’ meetings. If you believe assets are being mismanaged or sold below value, document your concerns in writing and send them to the assignee. If the assignee is unresponsive or the issues are serious, consult with an attorney about a superior court petition.
Active creditors get better outcomes. Assignees who know that creditors are paying attention make more careful decisions. A creditor who never communicates and simply waits for a check has less influence over how the estate is administered than one who engages, asks questions, and holds the assignee accountable.
